We offer the following services to clients:

Provide IRS Representation to Taxpayers by a Professional Licensed Enrolled Agent (EA).

An Enrolled Agent is generally the best person to hire for help with IRS Problems. The benefit in hiring an Enrolled Agent is because an Enrolled Agent is licensed by the Internal Revenue Service under the authority of The United States Treasury Department. Thus, Enrolled Agents hold a specific knowledge about IRS rules, regulations and procedures. The IRS refers to Enrolled Agents as an “elite status” on their government website and states that the status of an Enrolled Agent is the “highest credential the IRS awards.” Taxpayers have the right to representation under the tax code and should get representation in matters or problems related to the Internal Revenue Service. Triage Tax Relief provides this professional representation to clients.

Consult with Taxpayers about IRS matters to determine a plan of action for their problem.

A Client Engagement Specialist will speak with Taxpayers in a consultative manner to determine the general nature of their IRS problem and will then outline a plan of action for Triage Tax Relief’s Enrolled Agents to handle the matter.

Consult with clients and State Taxing Authorities on State tax matters.

Prepare and file Federal tax returns.

A large number of IRS problems are a result of having unfiled federal tax returns. Therefore, preparing and filing federal tax returns is critically important to resolving IRS problems because it puts our clients back into federal tax compliance with the IRS. Taxpayers must be in federal tax compliance before the IRS will allow other issues to be addressed or resolved. Triage Tax Relief will prepare and file back federal tax returns for clients.

Prepare and file State tax returns.

As is the case with the IRS, preparing and filing state tax returns is critically important because it puts our clients back into state tax compliance in the states that have an income tax. Because information and tax data flows down from the federal tax return onto the state tax return, a state tax return cannot be completed until a federal tax return is done. Triage Tax Relief will prepare and file back state tax returns for clients.

Deal with IRS letters and the matters resulting from those letters.

Letters from the IRS are very informative. They provide warning signs to actions that the IRS will begin to take with a Taxpayer. Additionally, IRS letters will also give a road map to action already taken by the IRS with a Taxpayer. Thus, it is critically important that Taxpayers who receive IRS letters in the mail open them up and read them. It is also very important that Taxpayers accept or pick up all Certified Letters from the IRS from the post office. The IRS will take action against Taxpayers regardless of whether they signed for the Certified Letter or not, so it is best to accept the letter so that the Taxpayer and their Representative will know what is happening or about to happen with the IRS. Many IRS letters are deadline driven so they need to be taken seriously and addressed quickly. Missing IRS deadlines as explained in certain IRS letters can mean a loss of Taxpayers rights under the IRS code. Triage Tax Relief can explain to prospective clients and engaged clients what the IRS letters mean and help clients protect their rights.

Deal with IRS collection matters which are commonly referred to as ACS, Automated Collection Systems or Automated Collection Services).

Simply stated, ACS means that a Taxpayer is in a collection status with the IRS so the intent of the IRS is to collect money from them. A Taxpayer’s Representative will need to speak to the Collections Department at the IRS to try and work out a Collections Alternative Plan. Alert: Taxpayers who are in Collections need to take immediate action because they are at risk of levy, lien, garnishment or asset seizure. Triage Tax Relief can address these collection matters.

Deal with IRS Wage Garnishments.

IRS Wage Garnishments mean that the IRS will send a notice to the Taxpayer’s Employer to garnish the Taxpayers paycheck. The amount of the wages to be garnished depends on a number of factors; including the number of dependents at home and payroll status (i.e. W-2 or 1099). Triage Tax Relief can get a reduction or a release of an IRS wage garnishment in many cases.

Deal with IRS Bank Account Levies.

IRS Bank Account Levies mean that the IRS will send a notice to a Taxpayer’s financial institution (bank, credit union, etc…) and have funds seized from their accounts. Triage Tax Relief can get a release of an IRS Bank Account Levy in many cases.

Deal with IRS Federal Tax Liens.

The IRS issues Federal Tax Liens to protect their financial interest in cases where a Taxpayer owes money to the IRS. Many people misunderstand the definitions between a Levy and a Lien. The simplest explanation about the two items is that Liens hold things and Levies take things. So a Federal tax Lien holds property or assets from being sold or transferred until the Lien is lifted. Federal Tax Liens can severally affect a person’s credit rating. Although difficult in many cases, Triage Tax Relief can get a release or a subordination of a Federal Tax Lien depending on case details.

Negotiate settlements, pay plans and other resolutions for outstanding tax debt.

All settlements, pay plans and other resolutions of outstanding tax debt with the Internal Revenue Service are determined by the Taxpayers ability to pay the debt. There are so many factors that determine a person’s ability to pay the IRS that Taxpayers should hire an Enrolled Agent to figure it out. The Internal Revenue Service will ask Taxpayers to either answer questions about their financial situation or they will ask them to complete an IRS Form 433. An IRS Form 433 is a detailed document that tells the IRS about a person’s income, assets and overall ability to pay the IRS. It is Triage Tax Relief’s strong belief that Taxpayers should not give or submit this information to the IRS without first hiring an Enrolled Agent to review and submit it for the Taxpayer, if necessary. There are certain situations where this information does not need to be given to the IRS, but the IRS is not generally going to tell Taxpayers when those situations apply. Triage Tax Relief can negotiate structure and put in place settlements and plans that are in the best interest of our clients and not the Internal Revenue Service.

Prepare and submit an Offer in Compromise (OIC) to the IRS.

An Offer in Compromise is the most popular and most talked about settlement option with the IRS. It allows Taxpayers to offer the IRS less money than what they owe them. It incorporates the same principles and approach as explained in the negotiated settlements services. An Offer in Compromise is based on a Taxpayer’s ability to pay and does require the submission of the IRS Form 433, so it needs to be done by an Enrolled Agent. Triage Tax Relief can prepare and submit an Offer in Compromise for clients that best reflect their ability or inability to pay the IRS.

Provide Audit Defense and Audit Representation.

Triage Tax Relief has 4 basic rules in regards to IRS Audits.

  1. Do Not Represent Yourself in an IRS Audit. Get Representation Immediately.
  2. Do Not Speak to an IRS Auditor or Agent about your audit case other than to say “I am getting Representation for my Audit so you will need to speak to my Representative.” Do Not Say Anything Else – Period. It can and probably will hurt you.
  3. Do Not Allow the IRS to come out to your home or place of business to conduct an Audit. Taxpayers have the right to Audit Representation — Get It Immediately.
  4. Do Not Hire the Person who prepared the tax return to represent you in the audit.

The percentage of Taxpayers who get audited by the IRS is very, very small. Therefore, when an IRS audit occurs, the IRS is very motivated to disallow items on a Taxpayers federal return so that they will owe money to the IRS. Consequently, the IRS is highly skilled in asking questions that benefit them and not the Taxpayer. Once a Taxpayer says something to an IRS Auditor or Agent, those words are on the record and cannot be taken back. Too often, Taxpayers innocently say something to the IRS in the Audit process that hurts them. Triage Tax Relief represents Taxpayers in IRS Audit matters.

Deal with Innocent Spouse and Injured Spouse matters.

There are certain and specific situations where Spouses can get some relief under the tax code from being held accountable for their Spouses tax debt. Triage Tax Relief represents Taxpayers in Innocent Spouse and Injured Spouse matters.

Deal with ID Theft as it relates to IRS tax issues.

The unfortunate situation of ID theft can be a tangled mess to unwind at the IRS. Triage Tax Relief will help Taxpayers with IRS problems caused by ID theft.

Deal with EIC (Earned Income Credit) issues.

This is an area of tax that has been the center of growing fraud in recent years so the IRS can be slow and stubborn in regards to resolving EIC cases. This is an area that relies heavily on proof and paperwork which can frequently get shuffled, stacked or lost at the IRS so Representation is important in EIC matters. Deal with Payroll Tax Problems (940/941 taxes).

Payroll tax problems can come from the withholding, submitting, reporting and filing of the taxes. However, it seems that the most common payroll tax problems come from not paying the payroll taxes and specifically the trust fund portion of the payroll taxes. The Internal Revenue Service generally doesn’t have much mercy in payroll tax matters so Representation is needed. The IRS can cast a wide net on people, who they will hold personally responsible for the payment of payroll taxes, including the assessment of civil penalties. Deal with IRS cases where an IRS Revenue Officer or IRS Revenue Agent has been assigned.

Taxpayers frequently learn that an IRS Revenue Officer or Revenue Agent has been assigned to their tax case when they show up to their home or place of business. As one might imagine, this is not a good situation. Just like in an audit case, Taxpayers should not speak with Revenue Officers or Agents about their IRS matters other than to let the IRS know that they will be hiring Representation and they will need to speak to their Representative. Revenue Officers are there to collect money so the actions that they take support collecting money from Taxpayers. Revenue Agents are there to audit Taxpayers. Deal with IRS problems related to 1099 income.

A significant number of 1099 income cases are related to audits, levies and garnishments. In regards to 1099 audits, the problems usually stem from the IRS disallowing expenses against the 1099 income because the 1099 income earner doesn’t have proof of the expenses or records needed to support the deductions. In regards to levies or garnishments, the IRS can take 100 percent of a person’s income when they are working on a 1099 arrangement.
